GORMAN & JONES, PLC PREVAILS IN DISPUTE OVER CREMATION

February 2013 – Sometimes disputes in probate go beyond money.  This was a case where a father had his entire estate planned with the exception of his cremation wishes.  When the father died, his son wanted to cremate the father but the father’s daughter did not. As a result, a dispute arose as to what to do with the father’s body.  Unfortunately, the mortuary holding the body could not do anything until the dispute was resolved by the court. So, to the court the dispute went. The father’s body had to be refrigerated during the length of the dispute.  The dispute took 110 days. After a contested hearing, Attorney Andrew P. Gorman was successful in obtaining the Court’s order of cremation to much relief of the son.
